Assessing property boundaries is both an art and a science. Disputes regarding property boundaries can arise for a number of reasons. Properties can be difficult to survey. Rough terrain and human error may lead to miscalculation. Older boundaries may have been determined with poor instrumentation.

One common boundary-related problem occurs when a gap of land — known in the surveying industry as a hiatus — is found between properties and does not belong to either party. These gaps, as well as boundary overlaps, tend to occur when properties are resurveyed and discrepancies are found in either a subsequent survey (the junior survey) or with the original survey (the senior survey).

The federal courts have settled many property boundary disputes. Over time, established procedures have evolved for resolving these discrepancies.

In U.S. v. Weyerhaeuser Company (1967), the 9th Circuit Court decided that discrepancies in surveys did not matter and that the original monuments — the permanently placed survey markers in the ground — marked the boundary, and any resulting hiatus was deemed public land. The courts have consistently determined that hiatus land shall remain in the public domain.

Cases regarding overlaps are more complicated. Courts have consistently said that when two officially accepted surveys conflict, and the result is an overlap, the survey that is senior in time takes precedent.

When it comes to court cases involving property rights, the concept of “first in time, first in right” is firmly established. In Wirth v. Branson (1878), the U.S. Supreme Court made it clear that once a property had been patented — title of ownership confirmed by the government — the government cannot convey that land to any second party.

Presidents and chancellors from 16 universities met in Dallas Sunday to discuss future conference membership plans and agreed to work on forming a new intercollegiate athletic association that would begin competition in the 2013-14 academic year.

This presidentially led association will ensure stability and be built upon the principles of operating at the highest level of integrity and sportsmanship, enhancing the student-athlete academic and competitive experience, bringing fiscal discipline into athletics and ensuring competitive fairness.

“This is an exciting development that will stabilize the current conferences and create the first truly national conference with members in five time zones and television viewership from coast to coast.  This partnership brings together like-minded institutions to improve the integrity and stability of intercollegiate athletics,” said UNLV President Neal Smatresk. “We are moving our plans forward rapidly and expect to complete our conversations in the near future. Look for further announcements soon as we work together on this exciting new venture.”

Universities involved in the discussions were the United States Air Force Academy, University of Alabama at Birmingham, Colorado State University, East Carolina University, Fresno State, University of Hawaii, Marshall University, University of Nevada, University of New Mexico, University of Nevada, Las Vegas, Rice University, University of Southern Mississippi, University of Texas at El Paso, Tulane University, The University of Tulsa and University of Wyoming. With the exception of Hawaii as a football only member, the participation would involve all sports.

The structure of the new conference will likely include:
• Membership of 18 to 24 universities
• National scope from the Atlantic Seaboard to Hawaii
• Championship football game format that includes semifinal match-ups
• Championship basketball tournament
• Regular season scheduling in divisions
• NCAA FBS affiliation
• Mechanisms to emphasize and improve academic standards and fiscal responsibility

The presidents and chancellors will have follow-up meetings over the next six months to fully develop the operational issues essential to the formation of the association.

According to the Federal Reserve, monthly consumer credit debt rose $19.3 billion in December for a total credit debt level of $2.498 trillion. Revolving debt, which includes credit cards, increased $2.8 billion to $801 billion. Non-revolving debt, including loans for cars, rose $16.6 billion to $1.697 trillion.

Personal income increased $61.3 billion or 0.5% in December. The personal savings rate was 4% in December, compared with 3.5% in November. Compared to a year ago, personal income rose 4.7%.

The Mortgage Bankers Association said its seasonally adjusted composite index of mortgage applications for the week ending February 3 rose 7.5%. Refinancing applications increased 9.4%. Purchase volume rose 0.1%.

Wholesalers increased their inventories 1% to $473.2 billion in December. This followed a revised 0.1% decrease in November. Sales at the wholesale level rose 1.3% to $413.1 billion in December. On a year-over-year basis, sales were 11.8% higher since December 2010.

The trade deficit increased to $48.8 billion in December from a downwardly revised $47.1 billion in November. Exports rebounded 0.7% to $178.8 billion. Imports advanced 1.3% to $227.6 billion.

Retail sales rose 1.8% for the week ending February 4, according to the ICSC-Goldman Sachs index. On a year-over-year basis, retailers saw sales increase 3.5%.

The Labor Department reported that in the fourth quarter, productivity rose at an annual rate of 0.7% and labor costs increased at an annual rate of 1.2%.

RENO, Nev.—The Reno Aces and the University of Nevada baseball team will renew their annual exhibition contest at 6:05 p.m. on Tuesday, April 3 at Aces Ballpark, with proceeds once again benefiting the Nevada Dugout Club, the entities jointly announced today.

The 2012 exhibition will mark the third-straight exhibition contest between Reno’s Triple-A affiliate of the Arizona Diamondbacks and the NCAA Division I Wolf Pack. The Aces defeated Nevada 9-3 last season, on the heels of an 11-1 victory in the inaugural game in 2010.

In each of the last two seasons, the Aces have made a $15,000 donation to the University of Nevada Dugout Club, an organization that serves as the main fundraising body of the University of Nevada baseball team.

The game will serve as the final tune-up for the Aces before opening the 2012 season on April 5, while Nevada’s student-athletes will have the opportunity to compete against some of professional baseball’s top prospects at the Triple-A level.

Once again this season, the game will be played in an exhibition format, with Aces pitchers and catchers playing for both squads. All players will use wood bats, and the contest will last between seven and nine innings, depending on the status of the Aces pitching staff. Utilizing the traditional Minor League Spring Training format, pitchers will be placed on a pitch count, and should a pitcher reach his limit, the game will immediately proceed to the next half inning.

Tickets for the game are $14 for adults, $10 for college students and $7 for children 12 and younger and seniors 62 and older. Aces season-ticket holders will have the chance to purchase tickets at a discounted rate of $10, and will be eligible for an exclusive presale opportunity. Tickets may be purchased online at www.RenoAces.com beginning Monday, March 20 and at the Reno Aces Ticket Office on Saturday, March 10.

Pending home sales, a forward-looking indicator based on signed contracts, fell 3.5% in December after a 7.3% increase in November. On a year-over-year basis, pending home sales are up 5.6%.

Orders for durable goods — items expected to last three or more years — rose $6.2 billion or 3% to $214.5 billion in December. This increase surpassed the 2.2% economists had anticipated and follows a 4.3% surge in November. Excluding volatile transportation-related goods, orders posted a monthly increase of 2.1%.

New home sales fell 2.2% in December to a seasonally adjusted annual rate of 307,000 units from a revised rate of 314,000 units in November. Compared to a year ago, new home sales are down 7.3%.

Retail sales fell 1.4% for the week ending January 21, according to the ICSC-Goldman Sachs index. On a year-over-year basis, retailers saw sales increase 2.8%.

The Commerce Department announced that gross domestic product — the total output of goods and services produced in the U.S. — increased at an annual rate of 2.8% in the fourth quarter of 2011. This follows a 1.8% pace of growth in the third quarter of 2011. For all of 2011, initial reports indicate the economy expanded 1.7%.

Initial claims for unemployment benefits rose by 21,000 to 377,000 for the week ending January 21. Continuing claims for the week ending January 14 rose by 88,000 to 3.554 million

Two junior college transfers and two prep products have enrolled in classes this semester at the University of Nevada, the Wolf Pack football program announced today.

Defensive backs Nigel Haikins and Markus Smith, both juniors, join the Wolf Pack from the junior college ranks while Reggie Coates and Andrew Main previously signed National Letters of Intent with Nevada in 2011 and delayed enrollment until the spring semester.

Haikins is 5-10 and 205 pounds and comes to Nevada from Diablo Valley College in the Bay Area. Smith is 6-1, 185 and joins the Pack from Riverside (Calif.) Community College.

Coates (Crespi HS; Canoga Park, Calif.) is a 6-1, 240-pound freshman defensive end while Main (Los Alamitos HS; Los Alamitos, Calif.) is a 6-3, 270-pound freshman offensive lineman.

More information on the players will be available along with the rest of the 2012 signing class, which will be announced Feb. 1
